she said ossais was a counsellor of hers at the protection of children abusing drugs program at the time.
while the teen was awol from the provincial program, she contacted ossais from lethbridge and the case worker drove down to meet her there.
ossais admitted getting a hotel room for them, saying she was concerned about the girl’s welfare.
“the complainant was a client/patient receiving treatment for severe drug addiction,” lamoureux said, in finding ossais guilty of criminal conduct for breaching her position of trust toward the teen.
“at the time of these events the complainant was suffering from drug-induced psychosis, and at some points was suicidal,” the judge said of the girl’s vulnerability.
lamoureux noted there was a “power imbalance between the accused and the complainant.”
she found crown prosecutor tiffany dwyer had proven sexual misconduct occurred in the hotel room, but not at any later point in the relationship between the two.
“the touching between the complainant and the accused involved the activities of the complainant touching the breasts of the accused, and the complainant sitting on the accused on the bed in the hotel room.”
a date for ossais’s sentencing hearing will be set next friday.
